Two Post-Conviction Avenues

There are two basic avenues for seeking post-conviction relief. This is through direct appeals and a motion for a new trial.

Motions for new trials are sought through Statues 44.10 in state court and 22.55 in federal court. This motion is often based on new evidence or ineffective counsel at the initial trial, heard by the same judge who presided over the initial trial. These motions can be submitted after the initial trial or after a guilty plea.
Direct appeals are appeals from the decisions of the presiding judge at trial to an appellate court. These can be done after a trial when reversal is possible.
